====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-05-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 366(A) of the Indian Penal Code.
3. It is alleged that this petitioner along with other F.I.R. named accused persons kidnapped the daughter of the informant while she was returning home after attending the call of nature.
4. Learned counsel for the petitioner submits that police after investigation submitted final form against the petitioner and there is no allegation of any sexual assault against the petitioner. As a matter of fact, it is a case of elopement. The victim was having love affair with co-accused Bibhishan Kumar
Patna High Court CR. MISC. No.28053 of 2024(2) dt.14-05-2024 2/2 and she fled away with him on her own sweet will. He further submits that co-accused Bibhishan Kumar has already been granted anticipatory bail by co-ordinate Bench of this Hon'ble Court vide order dated 03.04.2018 passed in Cr. Misc. No. 60819 of 2017. Petitioner claims clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Muffasil (Begusarai) P. S. Case No. 432 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
