JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition of Excise Act, 2016.

Near about 22 bottles containing 16.5 liter Indian made foreign liquor were recovered from a bus in which the petitioner and one co-accused Bittu Kumar Singh were traveling. Submission is that the petitioner does not have any criminal antecedent and as a matter of fact, he was caught by the officials on mere suspicion.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above
