Petitioners seek bail in Bahadurpur P.S. Case No.423 of 2018 instituted for the offence under Section(s) 272, 273, 420, 467, 120-B Indian Penal Code, Sections 30(a), 32(2), 33, 36, 41(1) of Bihar Prohibition and Excise Act, 2016. Prayer of the petitioners for bail was earlier rejected by this Court with liberty to renew prayer for bail after completion of six months in custody.

Counsel for the petitioners submits that petitioners are in custody since 24.09.2018. There is no likelihood of conclusion of trial within short time.

Patna High Court CR. MISC. No.27879 of 2019(2) dt.01-05-2019 2/2 There is allegation of recovery of 2280 bottles of foreign liquor each of 375 ML; total 880 litres from the vehicle of the petitioners.

Keeping in view the observation made earlier by this Court, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge IV cum Special Judge, Darbhanga, in connection with Bahadurpur P.S. Case No.423 of 2018 , subject to the condition that both the bailors shall be close relative of the petitioners.

Further, (i) the petitioners will remain present on each and every date of trial, (ii) Their absence on two consecutive date(s) without any reasonable cause will make their bail bonds liable to be cancelled, and (iii) the petitioners will not intimidate the witnesses in any way and will not hamper the trial.
