JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2016 Learned Counsel for the petitioners, at the very outset, submits that petitioner no. 1, namely, Manish Kumar Ram @ Manish Ram, has been arrested and this application, so far as petitioner no. 1 is concerned, has become infructuous.
This application, so far as petitioner no. 1, namely, Manish Kumar Ram @ Manish Ram is concerned, id dismissed as having become infructuous.
Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Andar Police Station Case No. 164 of 2015, disclosing offences under Sections 147/148/148/341/323/
Patna High Court Cr.Misc. No.36999 of 2016 (2) dt.19-09-2016 2/3 324/307/504/34 of the Indian Penal Code.
From the First Information Report, it appears that consequent upon some altercation between the parties, some occurrence had taken place.
Learned Counsel for the petitioners has submitted that all the injuries have been found to be simple in nature and that the petitioners have no criminal antecedents. He has submitted that there is no chance that the petitioner will flee from the course of investigation or trial, if grant privilege of anticipatory bail. Considering the above submissions, this application is allowed.
Let the petitioner nos. 2, 3 and 4, namely, Ramesh Kumar Ram @ Ramesh Kumar, Dukhi Ram and Anil Ram, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri D. K. Mishra, learned Judicial Magistrate, 1st Class, Siwan, in connection with Andar Police Station Case No. 164 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the
Patna High Court Cr.Misc. No.36999 of 2016 (2) dt.19-09-2016 3/3 police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bails bond shall be liable to be cancelled.
