2. In this case, the petitioner is seeking regular bail in connection with Pothia P.S. Case No. 03 of 2025, registered for the offences punishable under Sections 8(c), 21(b) of NDPS Act.
3. As per allegation, 7.13 gm of smack was recovered from the possession of the petitioner.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. On similar ground, co-accused Abhinandan Kumar has been granted bail. The aggregate weight of contraband recovered from the three accused persons is slighter above the
Patna High Court CR. MISC. No.24041 of 2025(4) dt.06-08-2025 2/2 small quantity. The petitioner is under custody since 8-1-2025.
5. Considering the above-mentioned facts and circumstances, especially the period of incarceration, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar in connection with Pothia P.S. Case No. 03 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
6. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in any other cases, except the case mentioned in paragraph no. 3 of the bail petition, his bail bond shall not be accepted.
