1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 309(4) and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner has antecedent of two cases, it is next submitted Dhananjay Kumar had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 81470 of 2025 and the same came to be allowed by an order dated 12.01.2026, it is further submitted that case of the petitioner is similar to the case of Dhananjay Kumar and his name also transpired in the confessional statement of the Ravi Kumar in police custody which does not have any evidentiary value. The

Patna High Court CR. MISC. No.24302 of 2026(2) dt.03-07-2026 2/3 Court has perused the allegation as alleged in the FIR and also the order dated 12.01.2026 in Criminal Miscellaneous No. 81470 of 2025 and filed that the case of the petitioner is similar to the case of Dhananjay Kumar.

4. At this stage, learned counsel appearing on behalf of the petitioner submits that if privilege of anticipatory bail is granted the petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the order dated 12.01.2026 in Criminal Miscellaneous No. 81470 of 2025, the petitioner above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of where the case is pending/successor court in connection with Salaiya P.S. Case No. 85 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.

8. It is made clear that if the Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this Court is not cooperating in the investigation, in that event, learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner after recording reasons.
