The petitioners apprehend their arrest in connection with Nautan P. S. Case No. 71 of 2017 instituted under Sections 307, 323, 324, 341, 504 and 506/34 of the Indian Penal Code. The allegation, in brief, is that while the informant was returning back from market, these two petitioners caught hand of the informant and Ram Manohar Bhagat assaulted with knife on the chest of the informant, however, he escaped away. Learned counsel for the petitioners submits that on account of land dispute, these two petitioners have been falsely implicated and there is case and counter case in between both the
Patna High Court Cr.Misc. No.30409 of 2017 (2) dt.06-07-2017 2/2 sides. He submits that only allegation against the petitioners is of holding the hand of the informant but no allegation of assault and the injury found on the person of the informant is simple in nature and they have no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioners, namely, Jai Prakash Sah and Pankaj Kumar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Nautan P.S.Case No. 71 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
