JUSTICE SATYAVRAT VERMA ORAL ORDER 10-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Udwant Nagar (Gajrajganj O.P.) P.S. Case No. 148 of 2020 instituted for the offences under Sections 304(B) and 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 01.05.2020, is a person with clean antecedent and charge-sheet has been submitted in this case. Considering the fact that the deceased was married with the petitioner in the year, 2018 and efforts were made to cremate the dead body of the deceased on which police came to know and immediately rushed to the cremation ground and
Patna High Court CR. MISC. No.33239 of 2021(2) dt.10-01-2022 2/2 recovered the body and sent the same for postmortem from which it reveals that she died due to hanging. The conduct of the petitioner in trying to cremate the body in absence of the family members of the deceased and that marriage was only two years old, as such, presumption, for the purposes of bail, is against the petitioner.
Accordingly, prayer for bail is rejected.
