====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-07-2022 Heard learned counsel for the petitioners and the State.

Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 323/379/34 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that petitioners and other accused persons assaulted the informant and threatened to kill him. They took away his bag containing cash Rs.1.30 lacs and damaged his Swift Dezire car.

Learned counsel appearing for the petitioners submits that as a matter of fact vehicle of the petitioner dashed with the vehicle of the informant as a result of which some quarrel took

Patna High Court CR. MISC. No.34089 of 2021(3) dt.21-07-2022 2/2 place between the parties which resulted in lodging of the instant false case. All the offences are bailable except offence under section 379 IPC which is superficial in nature. Petitioners have got no criminal antecedent.

Considering the aforesaid facts, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Gopalganj Police Station Case No. 410 of 2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
