2. The petitioner is apprehending arrest in connection with Udakishunganj P.S. Case No. 38 of 2023 lodged on 24.05.2023, for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution, FIR has been lodged against the sole petitioner. Total recovery of 13 litres of illicit liquor has been made which is the subject matter of the present case.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that petitioner is an old man aged about 74 years and he has no criminal antecedent. Counsel submits that there is no

5. Learned APP for the State opposes the prayer for bail of the petitioner but submits that petitioner has no criminal antecedent.
6. As such, considering the aforesaid facts and circumstances as well as the age of petitioner, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge VII-cum-Special Judge Excise Judge-II, Madhepura, in connection with Udakishunganj P.S. Case No. 38 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dr. Anshuman, J) Divyansh/- U T
