JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Bhairab Sthan P.S. Case No. 26 of 2014 dated 27.02.2014 instituted for the offences under Sections 392, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the F.I.R. In fact, the F.I.R is lodged against unknown. The deceased was waylaid by the miscreants and was divested of Rs. 2,20,000/-. Later, during the course of the investigation, one Md. Israil was arrested who disclosed the complicity of the petitioner as well.

The learned counsel for the petitioner has submitted that the aforesaid Md. Israil has been granted bail by a Bench

Patna High Court Cr.Misc. No.15870 of 2018 (2) dt.06-04-2018 2/2 of this Court.

For the reason that the name of the petitioner has transpired in the confession of a co-accused who has been granted bail now and that the only prior case against the petitioner is under Section 498A I.P.C, this Court is inclined to grant anticipatory bail to him.

The petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, is directed be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Jhanjharpur in connection with Bhairab Sthan P.S. Case No. 26 of 2014.
