Having regard to the nature of allegation for offence under Sections 147, 148, 149, 341, 323, 324, 325, 379 of the Indian Penal Code, this Court is not inclined to grant privilege of anticipatory bail to the petitioner basically because it is the mother who is the informant and has alleged that when she had gifted the land to one of his daughter-in-law, it was the petitioner and his wife who had not only badly assaulted her but also her other son namely Bishundeo Singh causing fracture on his shoulder on the fateful day only on account of some land dispute. The petitioner, having assaulted his mother and the elder brother which are also confirmed from the injury report, is not entitled to grant of privilege of anticipatory bail.
Patna High Court Cr.Misc. No.49772 of 2015 (2) dt.04-11-2015 Accordingly, the prayer for anticipatory bail of the petitioner, namely, Binod Singh is rejected.
