====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-07-2016 Heard Sri Pushpendra Kumar Singh, learned counsel for the petitioner and learned A.P.P.

The sole petitioner, apprehending his arrest in connection with Sonebarsa P.S. Case No. 148 of 2015 registered for the offence under section 147, 148, 341, 323, 307, 324, 354, 379 of the Indian Penal Code, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that in the F.I.R. six persons were arrayed as accused and out of six accused persons four have already been extended the privilege of anticipatory bail vide order dated 18.4.2016 passed in Cr. Misc. No. 14086 of 2016. He further submits that the injuries found on the person of the injured have been found simple in nature . No.28428 of 2016 (2) dt.28-07-2016 2/2 dispute occurrence had taken place however subsequently good sense prevailed in between the parties and informant has filed a petition for compromise before the court below. Learned counsel for the petitioner has drawn my attention to Annexure- 4 to the present petition. On the aforesaid grounds a prayer has been made for extending the privilege of anticipatory bail. Learned A.P.P. opposing the prayer submits that there is specific accusation against the petitioner. However in view of the facts and circumstances particularly the fact that other four accused persons have been extended the privilege of anticipatory bail, the court is of the considered opinion that there is no reason to deny the same relief to the petitioner.

Accordingly in the event of arrest or surrender within a period of six weeks from today, let the petitioner Maheshi Rai be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sitamarhi/ concerned court in connection with Sonebarsa P.S. Case No. 148 of 2015 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
