JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, it came to light that petitioner used the looted mobile after occurrence and on the aforesaid basis, petitioner was made accused in the present case. Petitioner does not have any criminal antecedent and there is nothing in the impugned order that looted mobile was recovered from possession of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.32907 of 2019(2) dt.20-05-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Bharrahi) P. S. Case No. 15 of 2017.
