The petitioner retired after attaining the age of superannuation on 31.01.2020.

The grievance of the petitioner in the present writ petition is that the petitioner has not been paid post retiral benefits and the benefit of pay fixation under 5th, 6th and 7th pay revision.

Considering the fact that the petitioner has superannuated on 31.01.2020, the writ petition is disposed of with the direction to the respondents to ensure payment of entire

Patna High Court CWJC No.7084 of 2020(2) dt.08-07-2020 2/2 post retiral dues to the petitioner within a maximum period of four months from the date of receipt/production of a copy of the order.

The Executive Officer, Madhubani Nagar Parishad is required to provide a detailed calculation chart with regard to entire post retiral dues. He is also required to ensure payment of benefit of 5th and 6th pay revision within the same time. In the event the respondent Nagar Parishad has taken decision to grant benefit of 7th pay revision, the same may also be considered and granted to the petitioner at the earliest. In the event of failure to pay the post retiral dues within the time framed indicated above, the petitioner would be entitled to 9% interest from the date of filing of the writ petition till the date of actual payment.
