In this case, petitioners are seeking anticipatory bail in connection with Pakribrawan P.S. Case No. 02 of 2016 registered for offence under sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

Both sides are neighbours. The dispute arose on account of drainage. There is case and counter case from both sides. Specific allegation has been made against petitioner no. 1Ramadhar Yadav to have caused injury by Khanti. There is no specific allegation made against Satyendra Yadav- petitioner no.2.

Patna High Court Cr.Misc. No.28647 of 2016 (2) dt.26-07-2016 2/2 Looking to facts and circumstances of the case, the Satyendra Yadav-petitioner no. 2, in the event of arrest or surrender before the court below within a period of four weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Pakribrawan P.S. Case No. 02 of 2016, subject to the condition as laid down under Section 438 (2) Cr. P.C. As there is specific allegation against petitioner no. 1Ramadhar Yadav to have caused injury by Khanti, his prayer for anticipatory bail is rejected.
