JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Daudnagar P.S.Case No. 357 of 2017 registered under Sections 379, 411, 353, 333, 332, 323, 504, 506, 147, 149 of the Indian Penal Code and Section 40 of the Bihar Minor Mineral Concession Rules.

It is submitted by Mr. Krishna Prasad Singh, learned Senior Advocate appearing for the petitioner that the First Information Report has been lodged against the petitioner merely on suspicion. He submitted that the petitioner was neither named nor is there any material to connect him with the alleged offence. The seized Mahindra Tractor is owned by one Basant Kumar, who

Be that as it may, regard being had to the nature of allegation and the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S.Case No. 357 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
