JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Katihar Muffasil P.S.Case no. 59 of 2015 instituted under Sections 341, 323, 324, 307, 354, 509, 379, 504/34 of the Indian Penal Code.

It is alleged by the informant that on the alleged date of occurrence in the morning while the informant was going to ease herself in a maize field, the accused Md. Juber taunted by using vulgar words to her. The informant raised objection, upon which all the accused persons came there and said to kill her and bury her in maize field. Accused Atin attacked with Chaku on her neck and she sustained cut injury. At the same time, the accused

It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners have falsely been implicated in the present case, which is evident from Annexure 2 to the present application. From perusal of injury report it appears that the injury is simple in nature. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S.K. Sharma, learned J.M., 1st Class, Katihar in connection with Muffasil P.S.Case No. 59 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
