Learned counsel for the petitioners seeks permission to withdraw the bail application so far as petitioner no. 2 is concerned since he has been arrested.

In view of such, the bail application so far as petitioner no. 2 is concerned is dismissed as withdrawn. The petitioner no. 1 apprehends his arrest in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 299 of 2016 (G.R. No. 780 of 2016 pending in the Court of Chief Judicial Magistrate, Lakhisarai under Section 379 of the Indian Penal Code The accusation is of theft of electric poll by this

Patna High Court Cr.Misc. No.33085 of 2016 (3) dt.20-08-2016 petitioner and one Anshu Kumar Yadav causing loss of Rs. 14500/- to the Electricity Department.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the court below and pray for regular bail, which shall be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
