This application has been filed for quashing the order dated 24.7.2012 passed by the Sub Divisional Judicial Magistrate, Patna in Pirbahore P.S. Case No.41 of 2005, G.R. No.490 of 2005 by which he has refused to discharge the petitioner from the case.

Learned counsel for opposite party no.2 has informed this Court that after the impugned order charges have already been framed against the petitioner and some of the witnesses have been examined.

In such view of the matter, there is no need to entertain this application.

Accordingly this application is dismissed. However,

Patna High Court Cr.Misc. No.45601 of 2012 (3) dt.16-04-2015 the petitioner will be at liberty to raise all the points before the court below at the appropriate stage.
