The petitioner apprehends his arrest in Narhat (Sitamarhi) P.S. case No. 6/2016 under Section 409, 420, 353/34 of the Indian Penal Code.

The petitioner, Arbind Kumar, Incharge Headmaster, and Secretary-cum-senior teacher, Brajesh Kumar, of Primary School, Kopin are alleged to have defalcated Government money to the tune of Rs. 3,36,758/-.

The learned counsel for the petitioner submits that petitioner and Brajesh Kumar withdrew Rs. 9,99,452/- for construction of the school building. Of course, some delay was caused but the petitioner and Brajesh Kumar have already constructed the building worth Rs. 10 lacs although they withdrew

Patna High Court Cr.Misc. No.36616 of 2016 (3) dt.03-10-2016 2/2 Rs. 9,99,452/-. Brajesh Kumar has already been granted anticipatory bail vide order dated 18.08.2016 passed in Cr. Misc. No. 31089 of 2016.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Nawada in Narhat (Sitamarhi) P.S. Case No. 6 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
