This application for grant of anticipatory bail arises out of Ghosi P.S. Case No. 79 of 2015, disclosing offences under Sections 341,323,504,379,307/34 of the Indian Penal Code. It is alleged that the petitioner along with others surrounded the informant and started abusing him. The petitioner is said to have assaulted him with an iron rod. Learned counsel for the petitioner has submitted that the petitioner has been implicated because of some land dispute between him and the informant. According to him, allegation of snatching of golden chain and cash worth Rs. 5,000/- is just superimposition. It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent.

Considering the above, this application is allowed. Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Ghosi P. S. Case No. 79 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
