====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-10-2020 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners are apprehending arrest in connection with Forest Case No. 79 of 2019 for the offence under Section 33 1(a)a1(b), 1(c) and 35 of the Indian Forest Act. Learned counsel for the petitioners would submit that the petitioner have no criminal antecedent.

The allegation against these petitioners is that they are involved in cutting of soil with intent to construct a road. Considering the fact that the petitioners have no criminal antecedent, the Court is inclined to grant anticipatory bail to the petitioners, let the named above be released on

No.23430 of 2020(2) dt.13-10-2020 2/2 anticipatory bail to the petitioners, let the petitioners named above be released on bail in the event of arrest or surrender within a period of one month from the date of communication of this order on furnishing bail bond of Rs.25,000/- (twenty five thousand)each to the satisfaction of learned ACJM, Sherghati, Gaya in connection with Forest Case No.79 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The petitioners shall deposit Rs.25,000/- cash each in the court below and the amount of Rs.25,000/- deposited by the petitioners shall abide by the final outcome of the pending criminal case.
