JUSTICE SHIVAJI PANDEY ORAL ORDER 16-04-2015 The petitioner is challenging the order of cognizance dated 20th September 1995 passed in Ramgarhwa P.S. Case No. 49 of 1993 whereby and whereunder the Sub-Divisional Judicial Magistrate, Raxaul has taken cognizance for offences under sections 25(A), 26 and 35 of the Arms Act.

Allegation has been made that Police party proceeded for investigation of Ramgarhwa P.S. Case No. 49 of 1993 and he got an information from the Chawkidar that the accused persons of the aforesaid case are hiding themselves in the house of Nagendra Singh. A raid was conducted and the accused persons seeing the Police started fleeing away from the house of Nagendra Singh. It was found that one Jata Shankar Singh tried to conceal one single barrel gun into cow-dung. The accused persons who fled away from the place of occurrence have been named in the body of the

Patna High Court Cr.Misc. No.45767 of 2012 (3) dt.16-04-2015 2/2 first information report. The petitioner has also been named in the first information report and recovery of illegal arms was made from his house.

In such view of the matter, this Court does not find any error in the order of cognizance.

Accordingly, this petition is dismissed.
