JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with Ghoshwari P.S. Case No.18 of 2017, registered under Sections 307, 341, 323, 504, 120B, 115 and 34 of the Indian Penal Code. Allegation is that the accused persons came to the house of the informant and Chandan Ram fired over the informant with his pistol causing firearm injury near his neck and the informant fell down. Thereafter these two petitioners also started firing from their pistol and escaped away.
Learned counsel for the petitioners submits that allegation of causing firearm is not against these two petitioners, it is specific against Chandan Ram and these petitioners have falsely
Patna High Court Cr.Misc. No.30473 of 2017 (2) dt.06-07-2017 2 / 2 been implicated in this case. It is further submitted that there are some criminal antecedents against these two petitioners but except one case, they have been acquitted.
Having considered the nature of offence and the fact that there is allegation against these two petitioners of firing and they have criminal antecedents also, prayer for anticipatory bail on behalf of the petitioners is rejected in connection with Ghoshwari P.S. Case No.18 of 2017, pending in the court of the learned Additional Chief Judicial Magistrate, Barh.
