JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2020 Heard Mr. Arun Kumar, learned counsel for the petitioner and Mr. Anant Kumar, learned APP for the State. The petitioner, who is in custody since 05.06.2020, seeks bail in connection with Paroo P.S. Case No. 247 of 2020, dated 07.05.2020, instituted for the offences under Sections 30 and 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears that a vehicle was intercepted and from the said vehicle, 167.760 litres of liquor was recovered. One Rajesh Kumar was arrested. He has disclosed the name of the petitioner as having run away from the vehicle on seeing the police party.

Patna High Court CR. MISC. No.21897 of 2020(2) dt.09-07-2020 2/2 Learned counsel for the petitioner submits that the accusation against the petitioner is only based on the confession of an arrested accused person.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Paroo P.S. Case No. 247 of 2020.

The application stands allowed.
