This application for grant of anticipatory bail, arises out of Gogari P.S. Case No. 237 of 2017, disclosing offences punishable under Sections 147, 353, 188, 504, 506, 323 and 341of the Indian Penal Code.
Learned counsel for the petitioners has submitted that there is general and omnibus allegation against the petitioners and no specific overt act is attributed to them. In fact, the petitioners have been made accused in this case on account of protest made by them against the irregularity in the Nagar Panchayat Election.
Patna High Court Cr.Misc. No.33263 of 2017 (2) dt.20-07-2017 Several representations in this regard have been made to the superior authorities, which is evident from annexure-2 and 3. No specific case is made out against the petitioners. Hence the petitioners deserve the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Khagaria in connection with Gogari Police Station Case No. 237 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
