Appellant is aggrieved by the order dated 13.03.2019 passed by the learned Additional Sessions Judge-Ist-cumSpecial Judge, Khagaria in connection with Beldaur P.S. Case No.147 of 2016 whereby the prayer for bail was rejected. The appellant is seeking bail in connection with Beldaur P.S. Case No.147 of 2016 for the offences under Sections 387, 365, 511, 341, 342, 323, 504, 506/34 of the Indian Penal Code and Section 3(i) (r) (s) of SC/ST Act. In the instant case, allegation is that one Pankay Yadav stopped the motorcycle and he sit on back side of the motorcycle and thereafter, four accused persons came and snatched his key and assaulted the informant and demanded

Learned counsel for the appellant would submit that there is no money transaction. The appellant has no criminal antecedent and he is in custody since 05.03.2019. Considering the fact that appellant has no criminal antecedent and in fact the money was not snatched in this case, the Court is inclined to grant bail to the appellant. Let the appellant, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist-cum-Special Judge, Khagaria in connection with Beldaur P.S. Case No.147 of 2016. Accordingly, the impugned order dated 13.03.2019 passed by the Additional Sessions Judge-Ist-cum-Special Judge, Khagaria, is set aside and the appeal is allowed.
