JUSTICE RAKESH KUMAR ORAL ORDER 29-08-2016 Heard Sri Vibhuti Ranjan Sonvadra, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Parsa Bazar P.S. Case No.137/2015 registered for the offence under Section 379 of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner, by way of referring to F.I.R. , submits that as per F.I.R. itself, alleged occurrence i.e. theft of tractor of the informant, had taken place on 22.08.2015, whereas F.I.R. was lodged on 04.09.2015 without any explanation regarding delay and that too only suspicion was raised against the petitioner. As per learned counsel for the petitioner, the petitioner has falsely been implicated by the informant in the
Patna High Court Cr.Misc. No.31866 of 2016 (2) dt.29-08-2016 2/2 present case. Only with a view to put pressure on the petitioner for not demanding due money, a false case was instituted. In view of facts and circumstances, particularly the fact that only suspicion was raised against the petitioner, let the petitioner, namely, Tantan Sharma @ Tantan Mistry, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Parsa Bazar P.S. Case No.137/2015, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U T
