JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2017 The appellants seek pre arrest bail in connection with Obra P.S. Case No. 134 of 2014, registered for the offences punishable under sections 341, 323, 504/34 of the Indian Penal Code and Section 3(1)(x)(xi) of the SC/ST (Prevention of Atrocities) Act.

Allegation against the appellants is that they abused the informant by calling caste name.

Submission of learned counsel for the appellants is that when the son of accused Nawal Yadav was crossing on that way on motorcycle and due to cow dung of the informant, he slipped causing hurt to the informant and due to which altercation took place thereafter the present case was filed. Further submission is that there is case and counter case. Heard learned Special PP also who opposed the

Patna High Court CR. APP (SJ) No.1768 of 2017 (3) dt.18-07-2017 prayer stating that after the investigation the case has been found true and charge sheet has been submitted.

Having heard both sides, in view of the facts and circumstances stated above, I am not inclined to grant privilege of pre arrest bail to the appellants. The appellants may surrender before the Special Court and make prayer for regular bail, and if any such application is filed, the learned Special Judge shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.

With the above observation, this appeal is disposed of accordingly.
