====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-05-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Karjain P. S. Case No. 147 of 2023 registered for the offences punishable under Sections 379, 302/34 of the Indian Penal Code.

3. As per F.I.R., on 3.10.2023 at about 9 PM, this petitioner along with co-accused Sushila Devi assaulted the sister of the informant with stick, strangulated her to death and looted household articles.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Informant is not an eye witness to the occurrence and petitioner has been made accused in this case only on suspicion. Petitioner claims

Patna High Court CR. MISC. No.23812 of 2026(2) dt.06-05-2026 2/2 clean antecedent and is in custody since 06.11.2025.

Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is brother-inlaw of the deceased and during investigation, minor daughter of the deceased, namely, Khushbu Kumar @ Rekha Kumari and husband of the deceased have supported the prosecution case. Doctor has opined cause of death as 'Cardio-respiratory failure due to asphyxia by strangulation'.

6. Considering the nature of accusation, gravity of the offence, statements of daughter and husband of the deceased and cause of death, prayer for regular bail of the petitioner is rejected.

7. However, since petitioner is in custody since 06.11.2025, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
