JUSTICE VIKASH JAIN ORAL ORDER 06-11-2015 As prayed, learned counsel for the petitioners is permitted to make corrections in paragraph 3 of the petition to correct the case number as 'Kundwachainpur P.S. Case No. 60 of 2015' in place of 'Kundwachainpur P.S. Case No. 51 of 2015'.
2. Heard learned counsel for the petitioners and learned APP for the State.
3. The petitioners apprehend their arrest for the offences alleged under Section 366A read with Section 34 of the Indian Penal Code registered in connection with Kundwachainpur P.S. Case No. 51 of 2015.
4. It is submitted that the petitioners being variously related to Kamlesh Kumar have been falsely implicated and in
Patna High Court Cr.Misc. No.50661 of 2015 (2) dt.06-11-2015 2/2 fact it was a case of elopement by the so-called victim girl with the said Kamlesh Kumar as evident from her deposition dated 12.08.2015. It is further submitted that the petitioners and others have been granted anticipatory bail by a Bench of this Court in connection with Kundwachainpur P.S. Case No. 60 of 2015 where similar allegation had been made against them.
5. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioners' arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kundwachainpur P.S. Case No. 51 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
