ANJANA MISHRA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/148 /323/324/307/379/504/506 of the Indian Penal Code. Learned counsel for the petitioners submits that the entire case is false and motivated and has been lodged only as a counter blast to the Complaint Case which was filed by them in the year 2015. Learned counsel for the petitioners submits that even as alleged, the injuries purported to have been made by these petitioners, have been found to be simple in nature and caused by hard and blunt substance. The said injury report belies the prosecution story.

In view of the facts and circumstances and that the petitioners

No.32830 of 2016 (2) dt.18-08-2016 P2/2 have no criminal antecedent, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case No. 87/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
