1. Md. Sarik @ Tup-tup Son of Md. Zeaul Haque Resident of Mohalla - Baignabad, P.S.- Biharsharif, District - Nalanda .... .... Petitioner/s
Versus
1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Man Mohan Kumar For the Opposite Party/s : Mr. Pranav Kumar(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-12-2015 Heard both sides.
The petitioner apprehends arrest in a case registered for the offences punishable under section 392 of the Indian Penal Code.
Prayer for anticipatory bail of the petitioner was earlier rejected by order dated 19.05.2015 passed in Criminal Misc. No. 34230 of 2015.
Learned counsel for the petitioner submits that the petitioner is alleged to have talked with the driver of the bus from which huge cash amount was looted.
It is submitted that the said mobile does not belong to the petitioner. Even the case diary did not disclose the name of the owner of the Sim.
Patna High Court Cr.Misc. No.49740 of 2015 (2) dt.16-12-2015 It appears that after considering all the facts, anticipatory bail application of the petitioner was earlier rejected. I do not find any fresh ground to re-consider the prayer for anticipatory bail of the petitioner. Accordingly the same is rejected in connection with Akbarpur P.S. Case No. 104 of 2014 pending in the court of the learned Chief Judicial Magistrate, Nawadah.
