The sole petitioner apprehending his arrest in Durgawati P.S. Case No. 137 of 2016 registered for the offence under section 341, 342, 166, 379, 384, 386, 389, 506 , 34 of the Indian Penal Code and section 65 (b)(c ) of the Bihar Excise (Amendment) Act 2016 has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. His name has come only in the confessional statement of one of the co -accused recorded
Patna High Court Cr.Misc. No.31833 of 2016 (2) dt.24-08-2016 2/2 under section 164 of the Cr.P.C. He submits that petitioner was simply a constable and there was no role to be played by the petitioner in the offence whereas on perusal of the F.I.R. I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
