JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Parsa Bazar P.S. Case No. 170 of 2017, dated 21.08.2017, instituted for the offences punishable under Sections 341, 323, 504, 379, 387 and 34 of the Indian Penal Code.
The petitioner and few others are alleged to have consumed tea and eatables from the shop of the informant and did not pay for the same. On asking for the cost of the eatables, the informant was assaulted and was also divested of Rs. 2,900/-, which was kept in the shop. There is also an allegation of demand of Rs. 25,000/- by way of Rangdari. Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.15766 of 2018 (2) dt.05-04-2018 2/2 that the dispute lay somewhere else, but the present First Information Report has been lodged with a different allegation. Realizing that the First Information Report has not been lodged with the correct version of the occurrence and with the intervention of well-wishers, the parties have tried to jettison their differences and a conscious agreement has been arrived at between the parties not to prosecute the petitioner and other accused persons in this case. The petitioner is a student of +2 and has a bright academic record.
Considering the aforesaid facts as well as the nature of accusation against the petitioner, this Court is inclined to enlarge him on anticipatory bail. Let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Cum-C.B.I.-II, Patna, in connection with Parsa Bazar P.S. Case No. 170 of 2017.
