The instant Criminal Miscellaneous has been filed for extending the date of surrender passed in order dated 14.05.2015 in Cri. Misc. No. 51659 of 2014 on the ground that the petitioner is a labour and he was not aware regarding the order passed as he could not contact his Advocate in time and when he came back from Punjab, he realized his inadvertent mistake and is filing this application for extending the time to surrender. The learned A.P.P. does not oppose the aforesaid prayer.
Accordingly, the petitioner is directed to surrender within two months from the date of receipt/production of a copy of
Patna High Court Cr.Misc. No.53306 of 2015 (2) dt.16-12-2015 2/2 this order and then he shall be released on bail on execution of bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri. Anchal Dwivedi, J.M. 1st Class, Saran at Chapra in U.T. No. 132 of 2010 arising out of Manjhi P.S. Case No. 119 of 2005, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Accordingly, this criminal miscellaneous is hereby allowed.
