2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Jandaha P.S. Case No.318/2025 registered for the offences punishable under Sections 25(1-B)a, 26, 27 and 35 of the Arms Act.

3. As per FIR, some unknown persons alleged to open firing near to the courtyard of one Chandeshwar Rai, whereafter informant who is a police official arrived at the place of occurrence along with police team and apprehended three co-accused persons.

4. It is submitted by learned counsel appearing on behalf of the petitioner that name of this petitioner transpires in this case on the basis of disclosure as made by apprehended co-accused persons. It is submitted that during the course of investigation, it transpires that allegation of firing is available against co-accused Sonu Kumar and as this petitioner was only pillion rider without attributing any overt act, he was implicated with this case without having any cogent

Patna High Court CR. MISC. No.23707 of 2026(4) dt.14-07-2026 2/2 material. It is submitted that one of the reason for implication of this petitioner with the present crime in question, as he found involved in three more cases of similar nature (Section 379 of the IPC), where he is on bail.

5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as prima-facie investigation negates any overt act attributed to this petitioner, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-VII, Vaishali at Hajipur/concerned Court, where the case is pending in connection with Jandaha P.S.
