Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through video conferencing.

The petitioner apprehends his arrest in connection with Complaint Case No. 919 of 2019 registered for offence punishable under Sections 323, 379, 420/34 of the Indian Penal Code.

As per allegation, co-accused Md. Ashif Ali, executed a sale deed in favour of the informant/complainant in respect of the land which is a Gairmazarua Aam.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.33973 of 2021(2) dt.08-04-2022 2/2 he is merely a witness of the deed and has no complicity in the alleged occurrence as the executant and the vendee have already made contract of transaction of that land.

He has also submitted that co-accused Vikash Kumar and Shobha Devi have been granted anticipatory bail by this Court in Cr. Misc. No. 32678 of 2021 by order dated 31.03.2022.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Patna City, Patna in connection with Complaint Case No. 919 of 2019, subject to condition as laid down under Section 438 (2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
