2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 191(2)(3), 126(2), 115(2), 109, 103(1) of Bharatiya Nyaya Sanhita, 2023 . 3 . The prosecution case in brief, is that informant namely , Chhotu Kumar alleged that on 23.09.2024 at about 4:30 PM , due to dispute regarding tying cows on the roadside , 13 named accused persons including this petitioner armed with deadly weapons brutally assaulted father of informant Kamil Mandal and brother of informant Adarsh Kumar. It is further alleged that during assault seven accused persons held Adarsh Kumar and struck him repeatedly on the head with iron rods due
Patna High Court CR. MISC. No.24473 of 2025(3) dt.29-07-2025 2/3 to which he sustained severe injuries. It is furthr alleged that on 24.09.2024 , brother of informant Adarsh Kumar died during course of treatment.
4. It is submitted on behalf of the petitioners that petitioner has falsely been implicated in this case due to land dispute in between the parties. Falsity of the F.I.R. is apparent from this fact alone that just after the occurrence which took place on 23.03.2024 , informant Chhotu Kumar lodged Pradhan Nagar P S U/D 22 of 2024 , on 25.09.2024 , in which informant has not disclosed name of any of the accused persons including this petitioner and after delay of 4 days of the alleged occurrence on 27.09.2024 , the instant F.I.R. has been lodged wherein it is alleged that 13 named accused including this petitioner assaulted informant , his father and brother, as a result of which brother of informant namely , Adarsh Kumar died during course of treatment. It is further submitted that as per F.I.R.
Patna High Court CR. MISC. No.24473 of 2025(3) dt.29-07-2025 3/3 the death of informant.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, delay in lodging the F.I.R., clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class Munger in connection with Bariyarpur P.S. Case No. 210 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
