JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 14-12-2015 Petitioner apprehends his arrest in a case under sections 341/323/308/379/504/34 of the Indian Penal Code. It is alleged that the petitioner hurled a blow on the head of one Krishna Manji by means of a handle of a Handpump causing bleeding injury.
Counsel for the petitioner submits that the injury caused to Krishna Manji was found to be simple in nature. Further, there is case and counter case between the parties. Prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered on its own merit preferably one the same day also taking into consideration that the injuries sustained by the victim was found to be simple in nature.
