JUSTICE ARUN KUMAR ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Chakia P.S. Case No.44 of 2017 registered under Sections 363 and 366A of the Indian Penal Code.

Allegation is that the daughter of the informant became traceless, later on it was found that SMS was sent to her mobile from mobile of the petitioner's son Tabrej Alam and suspicion is raised that Tabrej Alam and this petitioner conspired and kidnapped daughter of the informant for the purpose of marriage.

Learned counsel for the petitioner submits that the son of the petitioner Tabrej Alam had eloped with the informant's daughter and this petitioner has only been implicated being his

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 13th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Chakia P.S. Case No.44 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. as well as subject to the condition that petitioner will cooperate with the investigating agency in investigation.
