JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2018 The petitioner is apprehending his arrest in connection with Sasaram (M) P.S. Case No. 1245/2017, registered for offences punishable under Sections 366A/34 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the minor daughter of the informant.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to enmity and has nothing to do with the allegation and the victim girl is not minor. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case and also the fact that the victim girl has named the petitioner in her statement under Section 164 Cr.P.C., I
Patna High Court Cr.Misc. No.20550 of 2018 (2) dt.26-04-2018 2/2 am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is accordingly dismissed. However, the petitioner may surrender and make prayer for regular bail, which will be considered by the court below on the merit of the case.
