JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 17-12-2015 The original file with application of the petitioner in relation to Advertisement No. 1, dated 01.11.2012, as directed on 09.12.2015, has been produced. The Court has perused the same. There is no declaration by the petitioner with regard to his enrolment in the employment-exchange and there is an application filed by him that he is not submitting any document with the application form, for which he has requested time.

If this is what the original records reflect, then obviously, the petitioner has deliberately filed false and misleading affidavit in the present writ application trying to raise fingers against the respondents for his non-selection.

Patna High Court CWJC No.3294 of 2014 dt.17-12-2015 2/2 The Court was inclined to impose exemplary cost upon the petitioner for such conduct and start prosecution as well, but on an earnest plea made by the counsel for the petitioner, the writ application is dismissed, because the facts do not reflect the actual state of affairs. Petitioner is warned and cautioned to be careful in future for this kind of conduct and behaviour while approaching the court of law.

This order will be communicated to the District Magistrate, Buxar.
