====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-09-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Special Case No. 04 of 2018 arising out of RC-17/A/17, arising out of Bhagalpur, Kotwali, (Tilka Manjhi) P.S. Case No. 513 of 2017 for the offence under Sections 34, 120(B), 49, 419, 420, 467, 468 & 471 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by this Court in Cr. Misc. No.21698 of 2020 and the case of this petitioner stands on similar footing. The petitioner is rotting in judicial custody since long time. Hence, the petitioner may be enlarged on regular bail.

No.22914 of 2020(2) dt.16-09-2020 2/2 Considering the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-III -cum- Special Judge, CBI-II, Patna in connection with Special Case No. 04 of 2018 arising out of RC-17/A/17, arising out of Bhagalpur, Kotwali, (Tilka Manjhi) P.S. Case No. 513 of 2017, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner.

(b) Both the bailors shall be resident of territorial jurisdiction of the learned court below having immovable property within the jurisdiction of the learned court below. (c) The petitioner shall not leave the country without permission of the learned Trial Judge.

(d) The petitioner shall not indulge in tampering with the evidence.
