The petitioner apprehends his arrest in a case registered for offences punishable under Sections 401 and 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner's name has cropped up on the basis of statement of the co-accused persons, who were apprehended on the spot. It is urged that the petitioner was neither apprehended from the spot nor was anything recovered from his possession and his antecedent is clean.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the
Patna High Court Cr.Misc. No.37813 of 2016 (2) dt.17-09-2016 2 / 2 event of arrest/surrender before the court below within a period of six weeks from today in Delha P.S. Case No. 56 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
However, at the time of accepting bail bond, the court below would verify and assure itself regarding the criminal antecedent of the petitioner. If he is having clean antecedent then his bail bond would be accepted. If he is found to be involved in any other case before 10.08.2016 then he would be taken into custody.
