Petitioner has renewed his prayer for regular bail in connection with Ramkrishna Nagar PS Case No. 39 / 2021 corresponding to G.R. No. 919 / 2021 registered under Section 25 (1) (a) (1B) a / 26 / 29 / 35 of the Arms Act inasmuch as earlier bail application of the petitioner was dismissed as withdrawn in Cr. Misc. No. 39356 of 2021 vide order dated 2101-2022 granting liberty to the petitioner to renew his prayer for bail after three months.

Learned counsel for the petitioner submits that no fire arm has been recovered from the petitioner and he was only found sitting in the room along with another accused person namely, Mukesh Kumar Patel and fire arm was recovered from a

Patna High Court CR. MISC. No.25056 of 2022(2) dt.18-05-2022 2/2 bag kept in that room and the co-accused / Mukesh Kumar Patel has admitted that the bag belongs to him. The petitioner is in custody since 29-01-2021.

In view of the observation given by this Court earlier and the fact that petitioner is in custody since 29/01/2021, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- ( twenty five thousand ) with two sureties of the like amount each to the satisfaction of Mr. Sukul Ram, Sub Judge XIII -cum- Addl. Chief Judicial Magistrate -XIII, Patna in connection with Ramkrishna Nagar PS Case No. 39 / 2021 corresponding to G.R. No. 919 / 2021.
