JUSTICE RAKESH KUMAR ORAL ORDER 28-07-2016 Heard Sri Sanjeev Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is a lady, apprehending her arrest in Rautara P.S. Case no.27/16 registered for the offence under Section 47(a)(c)(e) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that the petitioner has falsely been made accused on an accusation of recovery of two liters of Mahua liquor, whereas learned Addl. Public Prosecutor submits that the allegation against the petitioner is that from the house of the petitioner, Mahua liquor was recovered.
Be that as it may, in view of nature of accusation,
Patna High Court Cr.Misc. No.28459 of 2016 (2) dt.28-07-2016 2/2 let the petitioner, namely Chutri Devi , in the event of her arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Rautara P.S. Case no.27/16, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
