JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 20-04-2015 This application under section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 18.07.2011/19.07.2011 passed by the learned Sub-divisional Judicial Magistrate, Nawadah in connection with Complaint Case No. C-485 of 2011 by which the learned Magistrate has taken cognizance of the offence punishable under section 498-A of the Indian Penal Code.
The order impugned was passed after taking into consideration the complaint petition, statement of the complainant on oath and the statements of witnesses. Two witnesses were examined in course of enquiry conducted under section 202 of the Code of Criminal Procedure. It would appear from the statement of the complainant on oath that she was married to petitioner no. 1 on 27.06.2009. She was kept well
Patna High Court Cr.Misc. No.47473 of 2012 dt.20-04-2015 for some time but subsequently, she was being subjected to cruelty for non fulfillment of demand of dowry. The allegations made in the complaint petition, prima facie, disclose an offence punishable under section 498-A of the Indian Penal Code.
In that view of the matter, I find no illegality in the order passed by the learned Sub-divisional Judicial Magistrate, Nawadah.
