JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Dumariaghat P.S. Case No. 218 of 2019 for the offence under Sections 363and 366(A) of the Indian Penal Code and Section 8 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.02.2020.

Having regard to the materials available on record including the statement of the victim under Section 164 of the Code of Criminal Procedure, the Court is not inclined to grant bail to the petitioner. Prayer for bail is rejected at this stage. However, the court below is directed to expedite the

Patna High Court CR. MISC. No.24842 of 2020(3) dt.05-02-2021 2/2 trial and conclude the same at the earliest preferably within a period of nine months from the date of receipt/communication of the order.

In the event the trial is not concluded within the time frame as indicated hereinabove, the petitioner may renew his prayer for bail.
